9. Our contract

When you place an order to purchase a product from spekkies.net, we will send you an email confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we dispatch that product to you and is confirmed by an email we send to you confirming that we have dispatched (the ‘Order Confirmation E-mail’). That acceptance will be complete at the time we send the Order Confirmation Email to you. Any products on the same order which we have not confirmed in a Order Confirmation Email to have been dispatched do not form part of that contract. You are seeking to enter into a contract with spekkies.net when you place an order.

10. Returns

If, in the unlikely event, you should receive your purchase in a condition that is less than perfect, please contact us immediately. We will happily repair or replace your purchase at the manufacturer’s discretion. If that is not possible, we will provide you with a full refund. The product however needs to be returned to us within 7 days with proof of purchase.

11. Pricing and availability

• Products listed on spekkies.net are usually in-stock. However, there may be times where certain products need to be backordered. A backorder occurs in situations when a particular model is popular and we have temporarily run out of stock. At the same time the manufacturer/distributor is also temporarily out of stock and they are in the process of manufacturing more. This is typical of the designer eyewear industry when the ranges of brands, models and colours are substantial.
• Unlike other online optical stores, our strong ordering systems and excellent relationships allow us push the distributors daily to expedite backordered items. Also with our worldwide logistics centers we have access to a wider range of eyewear that allows us to speed up delivery times. Usually we are able to get your order in much faster than other stores.
• Our service guarantee for delivery is 15 - 20 business days and up to 30 business days for backorders. As such, should you decide to cancel an order that can be delivered within these time frames, please note that there will be a 5% cancellation fee. However, should your order be delayed beyond the time frames listed above, there will be no cancellation fee imposed.However, as we order direct from the manufacturers, we can assure you that if we are out of stock, so is every other retailer out there.
• Similarly, manufacturers tend to retire certain products from time to time and as such, these products would be unavailable for purchase. While we try to constantly update product availability, there may be rare occasions whereby a purchased product is discontinued by the manufacturer.
• As we process your order, we will inform you by email if any products you ordered needs to be backordered or has been discontinued.
• Prices are subject to change and spekkies.net reserves the right to apply changes at any time at its complete discretion. Check the final price of sale before sending the relevant order form.

12. Electronic communications

When you visit spekkies.net or send emails to us, you are communicating with us electronically. We communicate with you by email or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

13. Alteration of Service or Amendments to the Conditions

We reserve the right to make changes to our website, policies, and these Conditions of Use & Sale at any time. You will be subject to the policies and Conditions of Use & Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). 14. Events beyond our reasonable control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

16. Shipping

All items purchased from spekkies.net are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. spekkies.net will use commercially reasonable efforts to ship Products. spekkies.net will use commercially reasonable efforts to package all shipments in a manner to prevent damage during shipment.

 

17. Governing law and jurisdiction

These conditions are governed by and construed in accordance with the laws of Singapore. You agree, as we do, to submit to the non-exclusive jurisdiction of the Singaporean courts. Your statutory rights are not affected by these terms and conditions

18. Disclaimers on Content

• spekkies.net has made all efforts to prevent the publication on its web site of content describing or representing situations of physical or psychological violence or which, according to the sensitivity of spekkies.net's users, might be deemed to violate civil beliefs or human rights and dignity, in all its forms and expressions.
